Terms & Conditions for Marty Motorbike Rental & Tours We you to carefully read our terms and conditions regarding the rental or tour of our motorbikes. **Deposits and Payments:** making a deposit or full payment for your reservation, you accept all terms specified here upon confirmation of your booking through email, our online reservation form, or other methods.
Terms and conditions agreement as below to be signed on site before the tour or rental.

1. Acceptance of Terms
By making a booking with Marty Motorbikes Rental & Tours ("Marty Motorbikes"), you agree to these Terms and Conditions.
2. Bookings and Payments

A booking is confirmed only after payment of the required deposit and receipt of a booking confirmation.
-
The remaining balance must be paid before the rental or tour begins unless otherwise agreed in writing.

Customers must provide accurate booking information, including licence details and any medical conditions that may affect their ability to ride safely.

Deposits are non-refundable except where Marty Motorbikes cancels the booking.
3. Cancellation Policy
Customer Cancellations
-
14 or more days before departure: full refund of payments made (excluding deposit).
-
7–13 days before departure: 50% refund of payments made (excluding deposit).
-
Less than 7 days before departure: no refund.
Cancellation by Marty Motorbike
Marty Motorbikes may cancel a booking due to severe weather, safety concerns, road closures, equipment failure, or other events beyond its control. In this case, all monies paid, including deposits, will be refunded. Marty Motorbikes is not responsible for any travel, accommodation, or other consequential costs incurred by the customer.
4. Rider Requirements
To rent or ride a motorcycle, customers must:

Be at least 18 years old.

Hold a current full motorcycle licence valid in New Zealand.
-
Present their original licence (and International Driving Permit if required).
-
Be physically and mentally capable of safely operating the motorcycle.
Marty Motorbikes reserves the right to refuse rental or tour participation where a customer appears unable to ride safely.
5. Bond and Insurance
A credit card bond is required before rental:

The bond may be used to cover:

Insurance excess

Damage not covered by insurance

Fuel charges

Late return fees

Fines, tolls, or other amounts owing
The bond will normally be released within 14 business days after return of the motorcycle, subject to inspection and any outstanding claims.
6. Insurance Cover
Comprehensive vehicle insurance is included in the rental price.
The customer remains liable for the applicable insurance excess for any loss or damage.
Insurance may be void if the motorcycle is:

Operated by an unauthorised rider;
-
Used while the rider is under the influence of alcohol or drugs;
-
Used without a valid motorcycle licence;
-
Used recklessly, illegally, or off-road without written approval;
-
Used in breach of these Terms.
Where insurance is voided, the customer may be liable for the full cost of repair or replacement and associated losses.
7. Customer Responsibilities
The customer agrees to:

Ride safely and obey all New Zealand road rules.
-
Wear an approved motorcycle helmet at all times.
-
Return the motorcycle in the same condition as received, fair wear and tear excepted.

Return the motorcycle with the same fuel level as provided.
-
Pay all traffic infringements, tolls, parking fines, and penalties incurred during the rental period.
-
Immediately report any accident, theft, damage, or mechanical issue.
8. Prohibited Use
Customers must not:
-
Allow any other person to ride the motorcycle.
-
Ride while affected by alcohol, drugs, fatigue, or impairment.
-
Use the motorcycle for racing, speed testing, competitions, or illegal activities.
-
Use the motorcycle on unsealed or off-road surfaces unless authorised.
-
Remove or tamper with GPS tracking equipment.
-
Modify the motorcycle in any way.
-
Take the motorcycle outside New Zealand.
Any prohibited use may result in immediate termination of the rental or tour without refund and may void insurance cover.
9. Vehicle Collection and Return
A condition report will be completed before and after each rental.
Late returns may incur:
-
NZ$50 per hour (or part thereof) for the first four hours.
-
A full day's rental charge after four hours.
If a motorcycle is not returned within 24 hours without agreement, Marty Motorbikes may report it as stolen and recover all associated costs.
10. Accidents and Damage
If an accident occurs, the customer must:

Stop and comply with all legal obligations.
-
Contact emergency services where required.
-
Collect details of all parties involved.
-
Take photographs where possible.
-
Notify Marty Motorbikes as soon as practical.
-
Complete any incident reports requested.
Customers must not admit liability to third parties.
The customer may be responsible for loss of income suffered by Marty Motorbike while a damaged motorcycle is unavailable for hire where permitted by law.
11. Guided Tours
Tour routes and itineraries may change due to weather, road conditions, safety concerns, or other circumstances beyond Marty Motorbike's control.
Participants must:

Follow all instructions given by tour guides.
-
Ride safely and responsibly.
-
Respect other riders and road users.
Marty Motorbike may remove a participant from a tour without refund where their behaviour creates a safety risk.
12. Mechanical Breakdown
If a motorcycle suffers a genuine mechanical failure not caused by the customer:

Marty Motorbikes will arrange repairs or a replacement motorcycle where reasonably possible.
-
The customer will not be charged for repair or towing costs.
-
A pro-rata refund may be provided if a replacement cannot be supplied.
Where a breakdown results from customer misuse, negligence, or breach of these Terms, the customer is responsible for all associated costs.
13. ACC and Limitation of Liability
New Zealand's ACC scheme provides cover for accidental personal injury. Where ACC applies, rights to sue for personal injury are limited by law.
Nothing in these Terms excludes rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other legislation that cannot legally be excluded.
To the maximum extent permitted by law:

Marty Motorbikes liability is limited to the amount paid for the booking.

Marty Motorbikes is not liable for indirect or consequential losses, including accommodation, travel, or lost holiday costs.
14. Privacy and GPS Tracking
Marty Motorbikes collects and stores personal information in accordance with the Privacy Act 2020.
All motorcycles are fitted with GPS tracking devices for:

Vehicle security;
-
Theft recovery;
-
Fleet management;
-
Emergency response; and
-
Dispute resolution.
By renting a motorcycle, the customer consents to GPS tracking during the rental period.
15. General
-
These Terms and the booking confirmation form the entire agreement between the parties.

New Zealand law applies to all bookings.
-
Any disputes should first be addressed through good-faith negotiation before legal proceedings are commenced.
-
If any provision of these Terms is found invalid, the remaining provisions remain in force.
Customer Acknowledgement
By making a booking, the customer confirms that they:

Have read and accepted these Terms.
-
Hold a valid motorcycle licence.
-
Have disclosed any condition that may affect safe riding.
-
Understand the risks associated with motorcycle riding.
-
Consent to the collection of personal information and GPS tracking as described above.
Marty Motorbike Rental & Tours
Waiver and Release
The undersigned understands the requirements and conditions and is aware that the tour / rental and its activities involve the risk of personal injury and damage or loss of property. In consideration of the benefits to be derived from participation in the tour / rental, the undersigned voluntarily accepts all risks of personal injury and property damage arising from participation on the tour / rental.
The clients of Marty Motorbikes hereby agree that they and their dependents, heirs, executors and assigns, do release and hold harmless Marty MotorBikes and the employees, directors, and representatives of Marty Motorbikes from any and all claims of illness, bodily injury, death or property damage or loss, however caused, arising from or related to this motorcycle tour/rental in New Zealand.
This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.
